A Denver police officer will face 10 days of unpaid suspension for inappropriate use of force after he used his police dog to attack a suspect who had his hands up and was following other officers’ directions to lie on the ground.

Technician David Miller “deployed his police service dog when it was not warranted by the totality of the circumstances,” according to a discipline letter obtained by The Denver Post through an open-records request. Miller also failed to turn on his body camera during the incident, for which he received an oral reprimand.

On Nov. 1, officers located a U-Haul van near West 6th Avenue and Federal Boulevard that had been reported stolen and was part of an armed robbery in Douglas County, according to the letter. The department used a helicopter to track the vehicle as it moved through the city and into Westminster.

At one point, the driver of the van stopped the car and ran from the vehicle, video from the helicopter showed. But as soon as the suspect saw a Denver police vehicle come around the corner, the man stopped. Two officers got out of the car with their guns drawn and told the suspect to show his hands and get on the ground.

The suspect immediately raised his hands in the air and followed officers’ commands to get on the ground. Miller then arrived on scene and his unleashed dog attacked the suspect, biting his arm, even as the man was being guided toward the ground without resistance, the letter states.

“By deploying his (police dog) on a suspect who was in the process of surrendering with an officer’s hands upon him, which resulted in the suspect sustaining a dog bite, Technician Miller’s misconduct involved a serious risk to both officer and public safety,” Dulacki wrote.

Miller had no previous similar disciplinary issues. His suspension is scheduled to begin Thursday.
